NERC Unbundle TCN, Establishes New System Operator

In a landmark move, the Nigerian Electricity Regulatory Commission (NERC) has announced the unbundling of the Transmission Company of Nigeria (TCN) and the establishment of a new entity, the Nigerian Independent System Operator (NISO). The NERC’s decision to unbundle TCN comes as part of ongoing reforms in the Nigerian electricity sector. The newly formed NISO is set to take over the market and system operation functions previously managed by TCN.

The NISO, officially named the Nigerian Independent System Operator of Nigeria Limited, will assume all market and system operation-related contractual rights and obligations from TCN. Regulatory Compliance: This move is in line with the Electricity Act 2023, which provided clearer guidelines for the incorporation and licensing of an independent system operator. Asset Management: NISO will manage all assets and liabilities pertaining to market and system operation on behalf of market participants and consumer groups. Implications for the Sector
The establishment of NISO is expected to bring about a more efficient and reliable electricity market in Nigeria.

Engaging in contracts for the procurement of ancillary services with independent power producers and successor generation licensees
carrying out market and system operations functions as specified under the Electricity Act and the terms of its license.Government’s Role, The Bureau of Public Enterprises (BPE) has been directed to incorporate NISO by May 31, 2024, under the Companies and Allied Matters Act (CAMA), 20202.

The unbundling has been met with optimism by industry experts who believe that the creation of NISO will lead to greater transparency and efficiency in the management of Nigeria’s electricity transmission system.

The NERC’s decision to unbundle TCN and set up NISO marks a significant step towards restructuring Nigeria’s power sector. With the operational commencement of NISO, stakeholders anticipate a more robust and well-regulated electricity market.
